On April 26, 2021, the Equal Employment Opportunity Commission (EEOC) announced that the 2019 and 2020 EEO-1 Component 1 data collection is now open. The deadline for submitting both 2019 and 2020 EEO-1 Component 1 data is July 19, 2021.
The EEO-1 Component 1 report is a mandatory annual data collection that requires all private sector employers with 100 or more employees, and federal contractors with 50 or more employees meeting certain criteria, to submit demographic workforce data, including data by race, ethnicity, sex and job categories. Due to the COVID-19 public health emergency, which delayed the opening of the 2019 EEO-1 Component 1 data collection, the EEOC is extending the data collection period this year from 10 weeks to 12 weeks in order to provide employers additional time to file for both years.
The filing by eligible employers of the EEO-1 Component 1 report is required under section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e-8(c), and 29 CFR 1602.7-.14 and 41 CFR 60-1.7(a). Employers can find additional eligibility information here.
Eligible employers that have not received a 2019 and 2020 EEO-1 Component 1 notification letter via U.S. mail should contact the EEOC’s Filer Support Team at FilerSupport@eeocdata.org. Employers that have received the notification letter, may now create user accounts using the “Company ID” and “Passcode” provided in the notification letter. Employers should also visit the newly launched EEO-1 Component 1 website for the latest filing updates and additional information.
Eligible employers can also visit the Filer Support Center where employers can request assistance as well as find helpful resources. However, it is imperative that employers should start preparing to submit data now in anticipation of the July 19, 2021 filing deadline.
