KY Governor Outlines Guidelines For Pools To Reopen


On June 16, 2020, Governor Andy Beshear published guidelines that public pools must take in order to be able to reopen safely starting June 29, 2020.

These guidelines break down into four main categories: (1) social distancing; (2) cleaning and disinfecting; (3) personal protective equipment, and (4) training and safety.  The overall goal with which they were drafted was to allow public pools to reopen while taking necessary precautions to prevent the spread of COVID-19.

Regarding social distancing, some of the steps pools must take include calculating their maximum capacity, spacing chairs 6 feet apart, and modifying traffic flow to minimize contact between employees and visitors.  Employees must also wear face masks.  Cleaning and sanitation requires frequency and use of safe and effective cleaning products.  Additionally, pools should work to provide patrons with means of personal sanitation (i.e. hand sanitizer).

After interpreting and fully applying the guidelines to their specific community, homeowner’s associations and condominium owners associations should place signage at their pool(s) to alert patrons of the new guidelines.  However, the aforementioned are only a fraction of all the requirement contained in the guidelines.  Associations considering how to apply these guidelines should consult an attorney so their efforts comply with the guidelines and other applicable state and local regulations.
